Filipe Martins, ex-assessor especial do governo de Jair Bolsonaro, foi detido preventivamente pela Polícia Federal em sua residência em Ponta Grossa (PR) em uma decisão que, segundo despacho do ministro Alexandre de Moraes, do Supremo Tribunal Federal (STF), teria sido motivada por uma ação envolvendo seus próprios advogados — e não por uma conduta direta atribuída a ele próprio no processo.
De acordo com a Revista Fórum, a ordem judicial que culminou na prisão de Martins teria sido baseada no que o magistrado entendeu como descumprimento de medidas cautelares a partir de interações ou publicações feitas por membros da defesa técnica. A análise da Corte considerou que tais atos, mesmo que praticados por terceiros — no caso, os advogados — teriam extrapolado os limites das cautelares impostas ao ex-assessor na investigação relacionada à tentativa de golpe contra a ordem democrática.
Martins já estava com a prisão decretada por entendimento do STF sobre risco de fuga e outras supostas violações das cautelares impostas no contexto da investigação da trama golpista de 2022. A execução da ordem ocorreu ainda no começo do ano, com agentes federais cumprindo a determinação no endereço onde ele residia, seguindo despacho de Moraes.
A situação provocou debate entre juristas e setores da opinião pública sobre a extensão das cautelares e a responsabilização de réus por atos de seus advogados, sobretudo quando tais atos não se originam diretamente do acusado.
