STF mantém Bolsonaro preso após Moraes rejeitar pedido de prisão domiciliar humanitária
Ministro do Supremo Tribunal Federal negou solicitação da defesa por cuidados de saúde, e ex-presidente voltará à Superintendência da Polícia Federal após alta hospitalar
O ministro Alexandre de Moraes, do Supremo Tribunal Federal (STF), rejeitou nesta quinta-feira (1º) o pedido da defesa de Jair Bolsonaro para que ele cumprisse sua pena em regime de prisão domiciliar humanitária, mesmo após sua alta do Hospital DF Star, em Brasília. Com a decisão, o ex-presidente deverá ser recolocado na Superintendência da Polícia Federal, onde cumpre pena pela trama golpista de 2022.
O pedido havia sido protocolado pela defesa ainda na quarta-feira (31), com argumento de que os recentes procedimentos médicos — incluindo cirurgia de correção de hérnia e outras intervenções — exigiriam cuidados especiais que não seriam adequadamente fornecidos em ambiente prisional. No entanto, Moraes avaliou que não foram apresentados “fatos supervenientes” ou justificativas legais suficientes para alterar a decisão anterior, que já havia indeferido pedido semelhante no fim de dezembro de 2025.
Segundo a decisão do ministro, os próprios laudos médicos indicaram melhora do quadro clínico de Bolsonaro, e não um agravamento de sua condição de saúde, argumento central da defesa. Moraes também ressaltou que todas as prescrições e cuidados médicos necessários podem ser assegurados na Superintendência da Polícia Federal, incluindo plantão médico permanente e acesso ilimitado de seus próprios médicos e terapeutas, sem prejuízo à sua recuperação.
A rejeição do pedido confirma a linha dura do STF em relação aos pedidos de alteração do regime de custódia do ex-presidente, que cumpre atualmente uma pena de 27 anos e três meses de prisão por sua participação em um plano para subverter a ordem democrática após as eleições de 2022.
Com a decisão, Bolsonaro deve receber alta hospitalar ao longo desta quinta-feira e, imediatamente em seguida, será escoltado de volta à sede da Polícia Federal em Brasília, onde dará sequência ao cumprimento da pena. A medida reforça a determinação do judiciário de manter a integridade do processo penal em curso, mesmo diante de apelos baseados em questões de saúde.
