Moraes dá 24 horas para Filipe Martins explicar descumprimento de medidas cautelares no STF
Ministro do STF cobra esclarecimentos sobre uso de redes sociais por Filipe Martins, condenado por tentativa de golpe, sob pena de prisão preventiva
O ministro Alexandre de Moraes, do Supremo Tribunal Federal (STF), determinou nesta terça-feira (30) que a defesa de Filipe Martins preste esclarecimentos em até 24 horas sobre o possível descumprimento das medidas cautelares impostas a ele, sob pena de decretação de sua prisão preventiva.
A decisão ocorreu após a juntada, nos autos do processo, de uma notícia de que o condenado teria utilizado a rede social LinkedIn para busca de perfis de terceiros, o que pode constituir violação das restrições impostas por Moraes — que incluem a proibição de uso de redes sociais enquanto cumpre medidas cautelares.
Na determinação, Moraes escreveu que os advogados regularmente constituídos de Filipe Garcia Martins Pereira devem apresentar, no prazo de 24 (vinte e quatro) horas, explicações detalhadas sobre as informações juntadas aos autos (eDoc. 1.697), sob pena de ser decretada a prisão preventiva do réu, conforme previsto no Código de Processo Penal.
Filipe Martins, ex-assessor de assuntos internacionais do governo de Jair Bolsonaro (condenado), foi condenado a 21 anos e 6 meses de prisão pela Primeira Turma do STF por participação na tentativa de golpe de Estado em 2022. Ele cumpre atualmente medidas cautelares desde que foi beneficiado por prisão domiciliar decretada pelo tribunal.

A alegada utilização de uma conta em rede social — ainda que para busca de perfis de terceiros — é entendida pelo ministro como possível transgressão das cautelares que restringem a comunicação pública do condenado e visam prevenir nova atuação que possa contrapor decisões judiciais ou incentivar ações contrárias à ordem democrática.
